Abstract

Traffic violations in the city of Surabaya often encountered every day, especially traffic offenses committed by motorcyclists. The violations of traffic carried by bikers in Surabaya will be followed by traffic police with a speeding ticket, that motorists who commit traffic offenses will be confiscated driver's license or the vehicle registration and replaced with a letter violations of traffic police can later be used as evidence in the District Court after participating in the hearing. However it’s does not always end up in court. For those offenders who do not want her case came to hearing, could be resolved by "damai". "Damai" is a situation in which offenders negotiating with the traffic police for violations that have been conducted, that the goal is to direct offenders to pay some money to the traffic police fines without having to speeding ticket. This issues wants to be the focus of research is how the construction of the driver the action of "damai" on a traffic violation in Surabaya. To determine the construction of "damai" on a traffic violation, the researchers used the theory of social construction Peter L. Berger with a constructivist approach. So it is concluded that the longest, queuing and complicated of tilang are avoided by the infringer.
