Abstract

The legal issues raised in this study are Criminal Accountability of Traffickers of Child Victims of Child Victims as CSWs. This research is normative research with approach of legislation, concept approach and case approach. The result of this research is: Character of the crime of trafficking of persons whose victims are girls is trafficking of persons whose purpose is to accrue sexual advantages and exploitation. Such sexual exploitation shall be realized in the form of actions with or without the consent of the victim, including but not limited to prostitution, Or servitude, slavery or similar practices of slavery, oppression, extortion, physical use, sexual, reproductive organs, or unlawfully transferring power or transplanting organs and/or tissues or utilizing one's own power or ability by others to benefit both material Even immaterial. Criminal accountability of traffickers of trafficking of persons whose victims are girls is evidenced by acts that contain elements of mistake in the form of intentional recruitment, holding or receiving of persons in trafficking by means of threats or the use of force or other forms of coercion with the intent and purpose of exploitation. Where the basic existence of a criminal act is the principle of legality, while the basis can be criminal is the principle of error. This means that the offender will be punished if he/she has an error in non-criminal conduct. Criminal liability remains applied to anyone who commits a criminal offense while the offender is able or able to account for his / her actions. However, in the case of punishment is certainly different depending on the category of criminal acts committed as well as articles that violated.
