Abstract

This thesis discusses the characteristics of debt in musyarakah contract. Musharaka financing is a joint venture capital between a bank and its customers that can not be discharged from the usual financing paradigm. Therefore, the provisions on working capital financing in general are also applied in the implementation of musyarakah financing. The financing provided by the Bank to its customers always creates so-called financing risks, as well as musyarakah financing. As with any agreement in general, the musyarakah contract is the will of the parties to engage in fellowship in it, listing the achievements that must be fulfilled by the parties. This achievement which then can incur liability, if there are parties in the contract that does not carry out the obligations or achievements that have been agreed in the contract that resulted in losses on the other party. The risk referred to in musyarakah financing is the failure of the customer in returning the portion of the bank's equity participation and / or the agreed profit sharing payment in the beginning of the musyarakah contract.
