Abstract

The purpose of establishment of stock exchange is to run the capital market which orderly, fair, and efficient. Driven from Article 9 law number 8 of 1995 that stock exchange also given a role as Self Regulatory Organization (SRO). This double function raises problems, what is the primary function of stock exchange, as well as how its characteristics as a SRO. The stock exchange potentially have conflicts of interest. According Article 8 law number 8 of 1995 shareholder of stock exchange also a member of the exchange. Therefore lead to lack supervision to its member and weaken law enforcement. The conclusions obtained, the stock exchange as a SRO is a front line responsibility that aimed to support stock exchange main functions as a facilitator. Government oversight through the regulator and demutualization needed to minimize conflicts of interest Securities Exchange as a SRO.
