Abstract

The government in accelerating the economic development of the people requires a lot of infrastructure facilities. For this reason, a strong construction service business is needed. One of the bank services is the financing of projects using construction work contracts, in which the loan agreement uses a transfer scheme for cessie rights. in the cessie scheme, this financing has a deviation in the legal theory, (1) where the receivables are billed at the time the agreement does not exist, (2) there is a notification requirement (betekening). where this is not needed, (3) risk factors in the construction work and the last (4) on the problem of execution in the event of a payment failure. The approach method is the legislative approach and the conceptual approach. In providing financing, this project relies on the capabilities of bank analysis. And the contract of government construction employment can be guaranteed because it has a high value of certainty, even though there is an institution that protects it (fiduciary) but will have difficulties in its execution, it is necessary to have additional guarantees on the credit agreement
