Abstract

This research has been carried out to study victimization in land matters in Indonesia. The field studies were conducted in Surabaya and Makassar. The objectives of the study are to observe how the victimization occured and to identify what factors lead to the victimization. Having known the process of victimization and found the factors resulting in it. it may be recommended a proper alternative solution of preventing victimization as a criminal policy. This research is a normative study supported by an empirical research. The emphasis of this research is land cases analysis from the victimological perspective. The data have been collected from library research as well as from field study. The respondents of the field study are land owners who have been victimized. From this research. it has been found that in most cases. victimization i6 attributed to the abuse of power by the authorities. They have manipulated the land use planning, by which they have unduly transfered the designated Public utilities to commercial interests. It. can happen because the authorities lack integrity. On the other hand, the government supervisory agencies did not work. In sum, both culturally and structurally. the Indonesia government are inappropriate. The victimization cases have been resolved through litigation as well as non-litigation.
