Abstract
Plastic Waste has become one of the most important global environment issue for so long. Due to the rapid development of science and technology, society demands and needs of plastic-based products has been so hard to control. It triggers a new phenomenon called plastic waste dumping done by particular party in the scope of transboundary waste trade. This research is a legal research which intends to scrutinize problems related to this phenomenon, such as: the principles and regulations of liability in regard of the plastic waste dumping, and also the restructurization and strengthen the law and regulation to overcome the plastic waste dumping issue. Method used for this research is doctrinal research with statute approach and conceptual approach. The result of this research demonstrates that states have liabilities on their actions that have caused environmental damages to other states. In the context of this research, Indonesia as an importing state in the international waste traffic could claim liability to export states that violated the waste trade regulations. In Indonesia the existing regulations on this matter are still not complex enough, also its enforcement and supervision are still poorly managed. Thus, states have to strengthen their international and national regulations regarding waste trade traffic or mechanism to prevent any potential loss in the future
