Abstract

BUMD is an institution that functions to advance the regional economy in accordance with the potential that exists in the region, one of which has a source of funding from the Regional Government as a shareholder or owner of the BUMD, in addition to adding capital to run its business activities, BUMD can apply for credit at the bank's financial institutions which is followed by guarantee of BUMD assets as the implementation of the bank's prudential principle. The issuance of Government Regulation Number 54 Year 2017 concerning Regionally Owned Enterprises has brought legal consequences on BUMD assets originating from the participation of Regional Government capital. PP Number 54 Year 2017 does not apply retroactively to BUMDs who have pledged their assets before the issuance of PP Number 54 Year 2017, so the obligation to repay credit loans must still be fulfilled so that BUMD assets remain assets belonging to the Regional Government. Therefore, this thesis seeks to elaborate the implementation of collateral for BUMD assets in the form of land and / or buildings originating from the participation of Regional Government capital and the existence of guarantees for BUMD assets in the form of land and / or buildings originating from Regional Government capital inclusion, since the issuance of PP Number 54 of 2017, through the concept approach and legislation approach.
