Abstract

Islamic banking institutions in housing finance attracted the attention of many people, especially in the Muslim country, Indonesia. Nowdays, in conducting sharia housing financing, there are financial institutions, both through banking and non-bank institutions, as parties that facilitate sharia housing financing. However, in fact non-bank developers that provides housing finance with non- usury actually practicing fictitious financing and deceiving many people. One of them is PT. Cahaya Mentari Pratama in Sidoarjo, East Java. Based on this problems, this thesis is analyzed the Independent Housing Financing Scheme at PT. Cahaya Mentari Pratama and Sharia-Based Housing Financing Institutions that Can Minimize the Potential of Fictional Housing Financing. In the research results, the public suggested use housing finance based on Islamic financial institutions, Islamic banking. With the aim of making the process safer and more reliable. This is because in the practice of financing banking institutions used murabahah contract which regulated the rights and obligations that must be filled in between the banking institution and the customer who carries out housing finance. Islamic banking institutions are intermediary institutions that carry out financing activities by channeling funds or providing loans to people who need funds as the goal of equitable distribution of people's welfare. This research approach uses a statute approac, case approach and conceptual approach.
