Abstract

Developments within the court environment are marked by the expansion of the court's authority in adjudicating various disputes within the government. The expansion of judicial authority is specifically regulated by law to resolve a dispute which broadly has legal consequences. In the implementation of general elections there are often disputes that cause legal consequences, these disputes can be in the form of disputes over the general election process or called administrative disputes and can also be in the form of disputes over election results. The Supreme Court provides strict boundaries for the two disputes as regulated in the Supreme Court Circular Number 7 of 2010 concerning Technical Guidelines for Regional Head General Election Disputes (Pilkada) which states that if the dispute in question is administrative or related to the general election process, the competent authority is is the State Administrative Court, while disputes relating to the results of the general election are the authority of the Constitutional Court. Therefore, this study intends to provide a complex explanation of the authority of the state administrative court with the existence of Law Number 8 of 2012 concerning the General Election of Members of the House of Representatives, Regional Representatives Council, and Regional House of Representatives.
