Abstract
The lasting customary stipulation (in Dutch: bestendig gebruikelijk beding) can be found in Articles 1339 and 1347 of Indonesian Civil Code (BW). This research discusses as follows: (1) the characteristics of lasting customary stipulations as one kind of factors in the fulfillment of contractual obligations; and (2) judges’ interpretation to probe the lasting customary stipulations in contracts. Statute, conceptual, comparative, and case approaches are adopted for addressing the research problems. After analysing legal materials, there are findings on the research. First, the lasting customary stipulations are legally binding whether parties enter into specific contracts in which the lasting customary stipulations, like customs or usages, are consistently observed by persons, enforced by an informal authority in particular communities, and proven in court. Second, judges have powers to interpret disputed contracts whether the disputed contracts are ambiguous by referring to the lasting customary stipulations of the contracts as part of unwritten law and inserting them into the disputed contracts by the judges as tools for decision making.
