Abstract

This thesis discusses the legal consequences of the void of the title of land rights encumbered with Mortgage Rights based on court decisions that have permanent legal force on the rights of creditors who hold the mortgage rights. The legal issues discussed in this thesis are the position of the Encumbrance Certificate on land rights which is guaranteed after the court decision declared the title of the land rights is void and the legal protection of creditors who hold mortgage rights over the land whose rights are declared null and void. The research method used is a normative research method with statutory, conceptual, and case approaches. The results of the research show that in the case of the title of land rights that have been encumbered with Mortgage Rights was declared void by a court decision that has permanent legal force, it can result in the cancellation and annulment of the Encumbrance Certificate. Then the legal protection for creditors who hold the Mortgage can be done in the form of preventive protection that is carried out before the credit is given, namely by conducting credit analysis through 5 of C, 7 of P and 3 R carefully and thoroughly. In addition, it can also be done by binding additional guarantees in the form of individual guarantees (Borgtocht). Whereas repressive protection is carried out in the event of a non-performing loan, then credit restructuring is carried out and if it does not work, then the credit settlement is carried out by making a lawsuit to court on the basis of breach of contract and can also be carried out by the bank by doing a write-off.
